Description of Service – Obligation of Hosting Provider
HostTitan.com provides reseller and dedicated services which can be used for business, personal use, and education. HostTitan.com provides these services with a network uptime guarantee of 99.999%.
This guarantee does not include errors caused by the customer or their end-users, planned service upgrades or maintenance (announced 24 hours in advance), hardware failures, or extraordinary circumstances. Extraordinary circumstances include but are not limited to Denial of Service attacks, fire, earthquakes, flooding, terrorism (cyber or otherwise), theft, or war.
In the event that HostTitan is unable to meet the uptime guarantee, a service credit will be granted equivalent to the amount of downtime occurred. Service credits cannot be redeemed for cash. Users must open a support ticket upon being aware of downtime. If a support ticket was not open during the occurrence of downtime, service credits will not be granted; Opening a support ticket insures that HostTitan has been made aware of the downtime.
Accounts suspended or terminated for abuse, will not receive reimbursements for any outstanding service credits.
Account Setup:
HostTitan.com (referred herein as “HostTitan” or “We”) verifies every order both manually and through a series of automated fraud check systems. In the event that the order is deemed high-risk, HostTitan.com may require up to 15 hours to perform further due diligence.
Email Address:
You are required to provide an email address. This information may be used to provide proactive support, billing inquiries, and abuse notification. In the event of an abuse inquiry, if your information on file is not current, HostTitan may suspend your account until we are able to get in touch with you. It is your responsibility to insure that the contact information is kept up-to-date. Please open a support ticket if this is to change.
IRC & Adult Hosting: We do not allow IRC or adult hosting at this time. Please do not sign up if you intend on doing either or the two. Your resellers must also abide by this requirement.
Transfer of Content:
HostTitan.com makes a best effort to help assist new users with the initial setup of their accounts. Our support staff will do everything possible to attempt to move all files, including mysql databases, mail accounts, and statistical log files. However, this is a courtesy service; we cannot guarantee its availability nor can we guarantee that we will successfully be able to transfer your site from another hosting provider. Every hosting provider is configured differently. This service is typically provided within 48 hours of signup. It is your responsibility to provide us with usernames and passwords. In doing so, you grant us permission to access and transfer files to our servers.
Spamming:
A zero-tolerance policy is in effect for spammers. In the event that your account spams, you will be subject to immediate termination with or without notification. In addition, you will not be issued a refund (See Refund Policy). If you plan to send a newsletter, have a script that sends large emails, or otherwise choose to utilize email in a manner that may subject you to spam complaints, you must speak to our support staff in advance. We make every effort to insure that our IP addresses are not blacklisted, and part of this effort entails regulating and monitoring users who utilize email above and beyond ordinary limits.
For resellers: If we believe that you unknowingly hosted spammers, we will only suspend your end-user’s account. However, if a pattern of abuse arises, we reserve the right to suspend or terminate your master account with or without reason. It is the subscriber’s responsibility to regulate their customers.
Phishing:
Under no circumstance can you use the Hosttitan.com service for phishing. In the event that we are aware of any phishing activity, your site will be subject to immediate suspension or termination with or without notice.
For resellers: If we believe that you unknowingly hosted a phisher, we will only suspend your end-user’s account. However, if a pattern of abuse emerges, we reserve the right to suspend or terminate your master account. It is the subscriber’s responsibility to regulate their customers. HostTitan.com has the ultimate discretion on all abuse cases.
Unlawful Activity :
As an entity located in the State of New Jersey (Princeton, NJ) with servers in New York, New York, HostTitan.com’s customers must abide by all applicable federal, state, and local laws. You may not use our servers to distribute child pornography, pirated software, hate content, and music or media for which you do not have a copyright.
Law Enforcement:
If requested by law enforcement, HostTitan.com may provide information regarding a subscriber’s account. This includes, but is not limited to, method of payment, information currently on file, IP addresses, and files owned/accessed by the subscriber.
Indemnification of Liability:
HostTitan will not be liable for any damage caused to you, your property, or clients. By using HostTitan services, you understand that, if used incorrectly, HostTitan services can cause damage to person's, places, or entities. HostTitan is indemnified from liability accured from said damages.
Backup Policy:
HostTitan is not responsible for lost data. There is no reimbursement; by joining our service, you agree to indemnify us of all damages directly or indirectly occurred from data lossed through human error, faulty hardware, and failing/failed hardware. We will do our best effort to recover data; the servers we offer typically have RAID-5, and are configured to be backed up nightly to a different server. However, it is ultimately the client’s responsibility to insure that they have a backup if the need arises for retrieval. We WILL NOT provide any compensation. Please plan to take frequent backups.
CPU Usage:
If you are on a shared server, you must be aware of the amount of resources you are using. This includes CPU usage. CPU usage should not exceed more than 25% for a 90 second duration. In the event that CPU usage becomes excessive, HostTitan.com reserves the right to suspend your account.
Refund Policy:
All Sales are final for collocation and dedicated Servers. HostTitan does not do refunds for provisioned items . Please noitfy hosttitan immediately should you wish to cancel. Future payments will be discontinued upon clear indiciation that you wish for the server to be disconnected.
> HostTitan will refund anyone who asks to be refunded within 30 days of initial sign-up. We will not honor the refund policy if you are terminated for abuse. This refund policy also does not apply to dedicated servers or collocation.
Bandwidth overages: Bandwidth overages are billed at $35/mbps or $1/gig (whichever is cheaper for the client). MRTG graphs willbe used to monitor client usage, and will be the final indication of bandwidth consumption used for dedicated clients. For shared clients, we use CPANEL to determine bandwidth consumption. In the event that a shared client exceeds there bandwidth, sales will make an effort to get in touch with the owner. If sales is unable to get in touch with the owner of reseller account, the account might be subject to suspension. If a user consistently exceeds their bandwidth allotment, they will be required to upgrade to an account with more bandwidth, or to a dedicated server.
Domain Renewal: HostTitan will not renew domain names automatically. Please be aware of when your domain expires. Generally, we contact our clients prior to a domain expiring. However, it is the client’s responsibility to renew a domain.
Cancellation: HostTitan must receive notice of cancellation at least 4 days prior to renewal of service. For domain names, HostTitan must receive notice of cancellation at least 2 weeks prior to renewal.
For domain names, if HostTitan does not receive notice of cancellation or renewal, HostTitan may choose to cancel or renew at its sole discretion. It is the domain owner's responsibility to inform us. If we are not informed, we will act on our sole discretion.
Deliquent Payment: If payment is deliquent, HostTitan reserves the right to suspend an account. If the payment is deliquent for over 16 days, HostTitan may terminate the account.
If payment is consistently deliquent, HostTitan reserves the right to terminate the account.
Debt Collection: HostTitan may utilize a third party collection agency to recover fees owed for services rendered.
Fraudulent Orders: In the event of a fraudulent order, HostTitan reserves the right to report all information to local, state, and federal law enforcement.
HostTitan may modify these terms with or without notice at any time. Please refer to this page from time to time.
